1. ACCEPTANCE OF TERMS

These Terms and Conditions (the "Terms") govern access to and use of the website of WINDOSMART Inc. ("WINDOSMART," "We," "Our"), a corporation incorporated under the laws of the Province of Quebec, Canada, as well as the submission of quote requests and any communication with us through the site. By accessing or using the site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the site.

2. NATURE OF THE SITE AND QUOTES

The site is a commercial showcase through which you may request a quote for our drone window cleaning products and services. No sale is concluded directly on the site. Prices, specifications, and availability displayed are provided for information purposes only and do not constitute a contractual offer.

Any quote issued by WINDOSMART is valid for the period indicated therein and remains conditional upon product availability and written confirmation by WINDOSMART. A contract is formed only upon written acceptance of the quote by both parties.

4. ACCEPTABLE USE

You agree not to: use the site for any unlawful or fraudulent purpose; submit information that is false, misleading, or belonging to a third party without authorization; attempt to gain unauthorized access to our systems or disrupt their operation; scrape, copy, or reuse the site's content by automated means; or use the site in any manner that could harm WINDOSMART or third parties.

5. INTELLECTUAL PROPERTY

The site and all of its content, including text, images, videos, logos, trademarks, graphics, and software, are the property of WINDOSMART or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right or license to such content, except a limited right to view the site for personal or legitimate business purposes related to our products and services. Third-party trademarks mentioned on the site, including DJI, remain the property of their respective owners.

6. PRODUCTS, RETURNS, AND WARRANTIES

The conditions applicable to product returns and refunds are set out in our Return Policy, which forms an integral part of these Terms. The use of equipment sold by WINDOSMART is subject to applicable laws and regulations, including Transport Canada regulations governing remotely piloted aircraft systems (RPAS). It is the purchaser's responsibility to hold the certifications, licences, and authorizations required to operate the equipment.

7. DISCLAIMER OF WARRANTIES

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, TO THE EXTENT PERMITTED BY LAW. WINDOSMART DOES NOT WARRANT THAT THE SITE WILL BE FREE OF ERRORS, INTERRUPTIONS, OR HARMFUL COMPONENTS, NOR THAT THE INFORMATION IT CONTAINS IS COMPLETE, ACCURATE, OR UP TO DATE AT ALL TIMES.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WINDOSMART SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE SITE, INCLUDING LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL. 10. GOVERNING LAW AND JURISDICTION

These Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of the Province of Quebec, judicial district of Montreal.

11. CHANGES AND GENERAL PROVISIONS

WINDOSMART may modify these Terms at any time; the current version will always be posted on this page with its last-updated date, and continued use of the site after posting constitutes acceptance of the changes. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. WINDOSMART's failure to exercise any right under these Terms shall not constitute a waiver of that right.
